my roommate is studying law and has about 30+ people studying in any of his classes. I just have to ask, do we really need more lawyers? Because after reading these articles, it makes me wonder if more lawyers = more stupid cases being taken to court?

I think suing has become the natural instinct of the American populace. Feel bad after getting hit by a car? No problem, sue the driver for negligence! It doesn't matter that it was your fault - you're a pedestrian, you have the right of way! You can't lose!

I think it isn't a matter of too many lawyers, it's a matter of too many money-hungry lawyers entirely too willing to find loopholes in the legal system in order to defend anyone with too much money and too little sense.

The world needs more Phoenix Wrights.

Actually, no. No objection here. I agree with that 100%.

There are some cases, though, like the one where the woman burned herself after spilling McDonald's coffee on her lap, that are actually pretty legit. The particular McDonald's she had gone to already had numerous health code citations about the temperature of their coffee and hot drinks -- they were way too fucking hot. So when that same restaurant served this woman her drink and she spilled it, she wound up getting third degree burns on her legs and sued the restaurant so she could cover the medical expenses that her insurance couldn't cover.

Wait. I totally didn't have a point to this.

The one and only time I've ever condsidered suing anyone was when the hospital I was at allowed a student to perform unsupervised oral surgery on me, without getting our consent or anything. The kid fucked it up, numbed the wrong part of my mouth, and then proceeded to attempt to remove bone from my jaw while I was still feeling 100% of the sensation. When he was faced with my shrieks and screams of pain, he calmly told me, "You're not feeling any pain, just the pressure. Relax." Everyone up and down the hall heard me screaming. Eventually the kid realized that he had put the needle into the wrong area, and therefore the veins had taken the novocaine to the wrong area of my head, and proceeded to give me another shot. When half of my entire fucking head was numb, he then went ahead with his surgery. I left the hospital afterwards gushing blood from my mouth and sobbing wildly. Never once did the kid consider getting a real doctor after he realized he had officially fucked up.

Anyway.

I think lawsuits should be there to protect and defend the people who actually need protecting and defending. Jackasses who sue over losing a fucking pair of pants should be dragged into the street and shot. It's kinda like girls who cry sexual harassment over anything and everything. If a woman sues her boss cause she just doesn't like him, you can bet she's gonna randomly throw in there "oh yea, he stares at my boobs a lot. Sexual harassment." It's unfair because there's very little the guy can do to defend himself. Between a guy and a girl, people are going to believe the "defenseless" girl. It makes the honest cases of sexual harassment, where the girls really are being harassed and abused, seem less important. It's the same idea: if people sue over anything and everything, the lawsuit itself loses importance. No one pays attention anymore. It's like, gee, someone make you mad? Sue them.

This is something I can't even understand. Especially when the shirts are cut so low (or skirts are cut so high) that other girls actually stop and stare.

If you don't want the hassle, cover the ass...le. Dammit. I was really trying to go for a trite rhyme there and just wound up with a contrived one.

You know, I often wonder why we didn't... more or less it came down to my mother: she didn't want to and I wouldn't have known how to do it on my own. "It's over and done, it's in the past now," she said. Fuck that. If we had sued, I could've easily gotten at least $50,000 in well-deserved compensation to cover the "mental anguish" to pay off my college loans and be settled nicely in a new state, ready to start my career. Confused

I work in a small but well-known legal office, and it's easy to guess that we get hundreds of cases in a year, and maybe one or two of those are weird or out-of-the-norm. The cases mentioned in the articles are real one-in-a-million things, and should be rooted out. It's like judging a racial group based off of the actions of a few people; you're not getting the right idea of the community as a whole.

Every society with an efficient legal system is like that. Feudal Japan was notorious for its complex system that had a lot of "funny in a bad way" lawsuits that could have been solved out of court, or left alone altogether. It's nothing to get up in arms about.


So here's to you Mrs. Robinson. People love you more- oh, nevermind.

I work at a court reporting firm, and I can vouch for some of the weirdness and/or bullshit people try to sue over (wow; that was so grammatically incorrect, I'm not even going to fix it). I just wish it wasn't so prevalent. It's like anyone who barely passed the bar can become a lawyer and probably will be hired to represent some dumbass in some dumbass case that'll wind up settling because of potential bad publicity.

Take this Subway case, for example. This is a ridiculous claim. When I say "ridiculous", I mean either that guy had somebody plant the knife, or some super disgruntled worker was... super disgruntled. How the fuck do you let a knife slip into bread like that? And don't they slice the sandwiches first? Come on, now. It reminds me of that fake-finger-in-the-Wendy's-chili incident.
