Yes, that's the part that disturbs me. What stops it there? Who's to say that I can't use the copyright when speaking?

No one is going to monitor it unless you say it in front of someone who cares.
In other words if you are with your friends and you say "I fucked Princess Peach".
You would be infringing upon a trademark because you are making up a fictional story about a trademarked character name.
But no one gives a shit.
I strongly suggest that you don't do that in the CEO of Nintendo's office.
Now what you could say is "I wish I could fuck Princess Peach".
That is not a trademark infringement because you are offering an oppinion.
Now, you could get away with saying "I fucked Princess Peach" if you truly believed it happened. Of course if you did you would be mentally retarded and we would be having a very different type of discussion here.
So I think to answer your question, proximity to select others matters when you say something that is a trademark. If you want to see how real this is, google Threepeat.

Or someone could leagally change thier name to "Princess Peach", and then there is no way to prove which one you were talking about when you declared that you fucked them.
AHA!

If it were a parody, then yes I think it is safe.
But it doesn't look like that is the case.

I forgot about the SomethingAwful deal. If nothing came out of that, then nothing will come out of this. Besides, how many sick freaks write SMB hentai stories?

If not parody, it is at least investigative journalism. One of the main reasons that I do FWSE is because it's sad, upsetting commentary on the state of internet. I get more searches for "erin esurance hentai" and "mortal combat fitalities" than I do for more of the actual content on the site. I did not create the image nor am I making any money off the image, I am simply using it to prove a point: no matter how retarded your fetishes are, the internet will sate them.

Hey, at least it isn't this NSFW Demotivator, or this barely SFW demotivator (they're both from Encyclopedia Dramatica, so it's not my fault if you get in trouble with your boss).
Also, here's a good one:

You could always tell them that the material is censored in complete cooperation with NOA's strict censorship policy. Then, when they tell you that they toned that down years ago, tell them that they're lying and ask them what else has happened in the past 17 years. Continue to put on the act that you were somehow cut off from the outside world and then laugh as they get mad or nervous and leave you alone. That's my profoundly stupid solution.

Holy crap. I return from a lengthy absence and what do I find? A bunch of white-collar fascists picking on you because of a poorly rendered drawing. America truly is a land of contrast.

Watch this blow over and you never hear anything from Nintendo of America again, because by the time you bring up freedom of speech, they don't tend to respond and shut their traps.

Just threaten to alert Mike Tyson to the whole M. Bison thing, and when they ask how that would implicate Nintendo as well as Capcom, point out that the SNES was the first console to host a port of SFII.
