Apple trying to patent touch cover like design

So after all this trouble with them going after Samsung allegedly violating a patent with their design for their Nexus, Apple is trying to patent a similar design to Microsoft's touch cover.

EDIT: I was wrong, looks like Apple first tried to file back in '11

Does this mean they'll get it through now that the Microsoft patents are in place?

Depends on how different it is. If it's effectively the same thing, the company who files first gets the patent. If there's a key difference, they will issue two different patents.

What I find interesting about all of these approved patents is that even though "First to File" is the current system, a patent isn't supposed to be granted to a company that can't prove that they invented something first.

So if two companies invent something within a short period of time, things would get dicey, however, in most cases Apple is using ideas from 10-20 years ago. Though they are being granted patents now, I think in the long run they will end up losing them and or some of these technological patents will become nullified.

then why not file them?
worst case scenario it gets rejected.

Because it costs time and money to file for a patent. Plus, while it protects your design, it also shows the world what it is, and patents expire. If you want to keep it entirely secret, you don't want to patent it.

Patent law is something that looks simple on the outside, but is extremely complicated once you get into it.
