My freshman year, this girl gave me her ex-boyfriends snowshoes, granted she was going to throw them out regardless. So I've held on to them back at my house for the past three years and we barely speak to each other, but yesterday, her "dog's" facebook messages me with this: "There is a pair of msr denalli snowshoes you owe (name withheld) She needs the snowshoes or the $200 that they cost nothing else will do. I will be checking in or I'll be visiting u have 30 days from today. 9/20/2010"
So I respond with this: "I'll try to find them back home. I'm pretty positive that I have them on my front porch, but I don't know exactly where. She told me that I could have them at the end of our freshman year, but I didn't know exactly what the deal was with them."
Today I get another message: "I have heard that before. Her dad has an inventory coming up so u have 30 days from yesterday. This isn't a nudge it's you being told snowshoes or the money or this could have the dec knocking or me"
Seeing as how she gave them to me the last day of her freshman year, saying that they were her boyfriends, now giving me semi-threatening e-mails it's giving me a lot of shit that I don't need to deal with.
So any advice?
Also the DEC isn't really the type of police agency that would be dealing with these kinds of situations, they are the Department of Environmental Conservation, which gives me the inkling that she's doing it herself. Also a Facebook message? how appropriate is that when you're trying to retrieve something with the threat of lawsuit?

Your story is a bit confusing, I'm not sure who is demanding the snowshoes back, or who owns them in the first place, or where her dad comes in. It'd be nice to know who the heck you're talking to.
But I'd just tell them that if they want them back sooner, they can go get them themselves. If you can't get to them, you can't, there's nothing you can do about it. And you sure as hell don't have to pay for them if you're willing to return them.
Legally, I don't think she has any leg at all to stand on. If they were hers to give away, it was a gift you're not required to return. If they weren't hers, then she has no right to demand them back at all, though if the rightful owner shows up you need to give it back.

Pretty much, I don't know who's demanding them back because she has a facebook account for her DOG, which I'm assuming she's using. They are apparently her dad's when she originally told me they were her boyfriends...

What does this mean? She has the account how? As an FB friend? Signed in on her home computer? What?
And again, you never should have admitted, on a recorded medium, that you had them. Now that possession is established, it could be claimed that you stole them and criminal charges could be filed.

They wouldn't go very far. First off, he accepted them in good faith. Second, it's been 3 years. Statute of limitations has run out (I checked). I'm not sure he's even under any sort of legal obligation to return them.

I would think that 3 years after receiving a gift, you're under no obligation to give it back. I guess technically she didn't own it, and thus it wasn't her gift to give, but I really can't see anyone coming after you and winning the argument.
And you'd think this "DEC" or whatever would just write off the $200. It's not like you stole a truck from them or something.

Still, as a general rule, in situations like this, be very careful what you say in e-mails, texts, or Facebook, because people are always look for new and exciting ways to fuck you over. Neither confirm or deny.

Yeah, I try to admit as little as possible about anything as a rule of thumb. But like Usa said, she doesn't have a snowshoe to stand on. Those snowshoes are yours and if she doesn't like it, tell her (not in a medium that she can record) to stick them in her ass.

I'm just confused in the first place. I'm not even sure I'm gathering this correctly, but you seem to infer that they're part of some inventory being taken stock of, and if that's the case, what company doesn't do inventory for three years? Plus, getting messages and what could be legal threats on Facebook? Smells like bullshit.

When they come to take them, just hand them the wrong shoes.
Claim that those are the only shoes you ever got.
There is no security camera or receipt that otherwise proves that you received anything, but like Syd said, you confirmed that you took something.

Yeah, the more I read it over, the weirder it gets. Are you a minor, Slayer 1? If so, you can't even enter a binding legal contract, and it's not like they were lent to you anyway. As for the value, she couldn't even charge you the full price at the time due to depreciation, especially if said snowshoes aren't in the original packaging or condition. If I were you, I would make a Facebook for your cat or whatever pet you have and politely inform the 'dog' of the harassment laws in your state.

You could block her on facebook (play dumb about it, like you don't know how it happened), then see if she still persues you through some other means. That might give you an indication of how serious she is. Not that I think it matters much, anyway.

Haha, I have the same general rule. I tend to deny knowledge of anything or anyone under questioning. I find that it can give you an advantage sometimes.....the person questioning you might give you some information you can use to your own advantage at a later time.
