Even after being issued a misdemeanor citation, Goodman contended, "this is an emergency, my McNuggets are an emergency." The McDonald's devotee is seen at right in a mug shot snapped after a previous encounter with police. Last month, a Florida man was arrested after he called 911 to complain about his displeasure with a Burger King combo meal. |

Doesn't McDonalds only give you four McNuggets? I always found that to be a ripoff, especially when you can buy a bigass bag of them from your local supermarket for at most seven bucks.

That is stealing.
While I wouldn't call 911, I sure as hell would contact McDonnald's Corporate about it and the BBB.
This is the same as ordering a $5,000 diamond ring and then having someone hand you $5,000 worth of coal and saying, oh well we ran out of diamond rings, but it is still worth $5k.

Yeah, I noteced that too. But I was too pissed over tying up the 911 line with her fucking call to care.
Although, thinking about it further, yeah, she should have contacted the police, the company or something. However, since what you described is completely illegal, I imagine the cashier was simply trying to convince her to buy something else. I imagine they would have refunded her if she kept insisting. A company like McD's simply *can't* get away with that.

You can't offer a product, take money and then not deliver without giving the money back unless you are a con artist.

Ok...
One of my co-workers is a lawyer. He said that there are two issues here.
1) The woman called 911 for a non-emergency. She should have called the non-emergency policy number. She should be fined for this and it looks like the cops did the correct thing about this issue.
2) McDonald's stole from her. The police should open a case and eventually this should lead to someone being arrested. The police have not yet handled this correctly.
Most likely a lawyer will offer to take her case for a percentage of winnings and will sue the shit out of McD's.

Yeah. I kind of thought small claims court required an issue of 25 bucks or more.
Then again, I'm sure a lawyer can find other things to sue for. And frankly, *IF* things played out exactly as stated in the article (and I'm still skeptical about that; I can't imagine an employee actively refusing to refund for a product they don't have n stock), McD's deserves it.

I was a police officer for seven years and customer disputes were not uncommon. The article to me is just exagerating something that occurs every day with the police. I can name dozens of calls I was on far worse than that one. If I had to venture a guess I would say the employee probably wasn't that bright and probably misunderstood McDonalds policy on refunds. Talking to a manager probably could have resolved the entire situation, but some people honestly aren't capable of thinking for themselves in those situations. The woman that called 911 is a prime example. She, like many people I've met, was probably unaware of the non-emergency number or what constitutes an emergency. Usually the dispatcher receiving calls like that tried to handle it over the phone unless it was violent, and if they couldn't resolve the situation they would then usually try to have an officer handle it over the phone. If both of those options failed only then would an officer be dispatched (and usually that officer would just repeat the same information the people on the phone told the caller). Some people just think having a police officer present will magically resolve any situation and won't accept any advice if its not in person. Where I worked unless it was an honest to goodness prank call people were almost never ever charged for calling 911, regardless of how stupid the call was. I am not saying the officers were in the wrong for citing her though. The article is very vague in what actually transpired, so there could be many factors that led to them citing her.

The crime of theft is not tried in small claims court. The tort of conversion is.
I don't think the cops are gonna cuff a kid over 3 bucks, and I don't think any reasonable person is gonna spend the court fees to recover 3 bucks (which seem to be her entire damages here...)

First off, thanks for your service, Officer.
More on point, what you said is pretty much exactly what I figured went down. The article is vague, and again I can't imagine it being anything more than a collision of idiocy and misunderstanding. I kind of assumed the employee was just 'upselling,' and trying to convince her to spend her money on something else. I'm sure had she pressed rather than freaking out, she would have gotten her money back.

Absolutely not. Service is service, regardless of the job. While specific heroes might warrant extra honors (be they military, law enforcement, firefighter, what have you), as a family of people who've chosen to serve their country, state, city or community, there is no hierarchy. At least not in my opinion.
