A Toronto woman whose husband left her after discovering that she had been having an affair is putting the blame squarely where it belongs: With her cellphone service provider, Rogers Wireless.
Rogers sent one “global” invoice to the home she shared with her husband, in which he discovered she had been making hours-long calls to one number; from there, he called the number, spoke to the “third party” with whom she had been having the affair, and walked out.
“I lost everything,” she says. “I want others to know what a big corporation has done. I trusted Rogers with my personal information. We had a contract — and agreement that put my life right in their hands.”
How much should the evil corporation, whose fault all of this is, cough up? $600,000, according to the woman behind the suit.

If that lawsuit fails, she should sue the cellphone maker. Claim that the radiowaves gave her a brain tumor which affected her judgement.

Yes, it's Rogers fault she's cheating on her husband.

This is why we can't have nice things.
Also why i am sure society is slowly degrading into dust.

sprint offers a 'no-calls listed' invoice option.

is there any clause in the contract that states the phone company is not bound by the contract if the user uses the service for illegal / immoral purposes, I know that affairs aren't really illegal but I think they count as immoral.

Suing for causing her divorce is ridiculous, but if there was some kind of breach of contract by the phone company, she's well within her rights to sue. I'm sure there are more ridiculous contract suits viewed with more legitimacy out there.

Yeah, while dumb to actually blame the company...if they did breech with this invoice, she might have an arguement...despite being a slut.

You know whats crazy in a good way? In the Military Having an Affair is illegal with a Maximum punishment of: Dishonorable discharge, forfeiture of all pay and allowances, and confinement for 1 year.

I agree that a breach of contract isn't correct, but hey, if you weren't out and about being the town Harlot then you wouldn't be in this situation in the first place. I feel no sympathy for her.

how about keeping up with your car payment? isnt that frowned upon in the military? if you fall behind on your bills i mean.
i get so many cats who are deployed or just got back from deployment and they are behind on their car note. i appreciate the fact they are in the military to protect our asses, but dont get mad at me for falling behind on your car note.

I guess you look at it this way, if you keep your nose clean in the Military, you won't get ass fucked and lose all your money, or do time in a Military Prison. The Military Justice system can be crazy from what I've seen. A true story from my first ship, with a little background on how the Navy's rank/promotion system works:
After you take an Advancement Test in the Navy, and the results come out and you get promoted, you get put into a 'frocked' period. Which means, using myself as an example, when results came out for my E-5 Exam, and I was promoted, I didn't get paid for E-5 for roughly 6 months. During that 6 month period, I was getting Paid as an E-4, but wearing an E-5's uniform. Thats your frocked period. If you get in trouble during that timeframe, you go to trial for what your being paid for. So...
Guy on my ship, just made E-5, and was in his frocked period. He knew his pay raise was coming up soon, so he went out, bought a new car, and got a new apartment. A week or two later he got a DUI. He was sent to Captain's Mast (Navy's Version of Court) and dropped him a Paygrade, and gave him 3 months of 1/2 pay. Since he was only being paid as an E-4, he was dropped to an E-3, thus losing TWO paygrades, And after his 3 months of half pay was being Dishonorably Discharged from the Navy.
His Solution to his Financial Woes? Putting an M-14 in his mouth and pulling the trigger on the ship while he was on watch.
1st offence in the Military? They don't care. They'll take you for all they can, then kick you out. So many people lined up at the recruiting offices these days, that "trouble makers" even for a fuck up like a DUI (and I'm sure we've all had that night where we shouldn't have drove) they'll clean you out, then kick you out.

wow, thats a fucked up story.
and i get all that about keeping your nose clean and all that jazz, but if you are keeping your nose clean, but you arent keeping up on your bill responsibilities, dont you get in trouble in the military for that?
i dont mean falling behind 1 or 2 days on your payments, but being behind 3 or 4 months and not having a good reason for it. some guy (i think he mightve been a marine) told me you can get into some sort of trouble if you dont keep up on your car payments & your mortgage or rent.

Yeah, you can't fall behind on things like that. If I'm too much indebt, or falling behind like crazy, two things can happen:
1) Lose my Security Clearance (which would place me out of a job)
2) Dock my pay every month to make me pay for my bills.
Losing your Clearance would happen in extreme cases if I were to owe 10's of thousands of dollars and what not. Enough to make being in Classified spaces or seeing information makes you a liablity.
I'm assuming collecting money is a part of your job, most of the time, a call to the persons command, talking to their higher-ups can solve that problem. They'll get involved and make the person pay, and usually send them to financial counceling (which they probably need anyway if they're getting themselfs that far behind) The Military isn't out to get its people. Just sometimes extreme things happen.

This reminds me of a time where a bar got sued by some guys family because the guy was breaking into the bar and got shocked and killed on a neon sign.
People who do bad shit then get hurt shouldn't win these kinds of cases.
She's at fault here. If she wasn't doing something immoral then her "husband" wouldn't have walked out on her. It's obvious she didn't care for him so this is just her seeing a opportunity to be a bitch and whine and hopefully make some money out of it.
As for the breach of contract issue, I don't think the companies at fault. They switched their home phone and internet to this company. Then when the husband mailed out for a global invoice the company would naturally assume that "global" means "all services related to this family" and would send out everything.
It's all the wife's fault. Plain and simple
