MADISON, Wis. — A man serving life in prison for first-degree intentional homicide lost his legal battle today to play Dungeons & Dragons behind bars.

Kevin T. Singer filed a federal lawsuit against officials at Wisconsin's Waupun prison, arguing that a policy banning all Dungeons & Dragons material violated his free speech and due process rights.

Prison officials instigated the Dungeons & Dragons ban among concerns that playing the game promoted gang-related activity and was a threat to security. Singer challenged the ban but the 7th U.S. Circuit Court of Appeals on Monday upheld it as a reasonable policy.

Dungeons & Dragons players create fictional characters and carry out their adventures, often working together as a group, with the help of complicated rules.

Singer, 33, has been a devoted player of the fantasy role-playing game since he was a child, according to the court ruling. After the ban went into effect, prison officials confiscated dozens of Dungeons & Dragons books and magazines in his cell as well as a 96-page manuscript he had written detailing a potential scenario for the game that players could act out.

Prison officials enacted the ban in 2004 after an inmate sent an anonymous letter expressing concern about Singer and three other inmates forming a "gang" focused around playing the game.

Singer was told by prison officials that he could not keep the materials because Dungeons & Dragons "promotes fantasy role playing, competitive hostility, violence, addictive escape behaviors, and possible gambling," according to the ruling. The prison later developed a more comprehensive policy against all types of fantasy games, the court said.

The appeals court said the prison's policy was reasonable and did not violate Singer's rights.

"After all, punishment is a fundamental aspect of imprisonment, and prisons may choose to punish inmates by preventing them from participating in some of their favorite recreations," the court said.

Singer was sentenced to life in prison in 2002 after being found guilty of first-degree intentional homicide in the killing of his sister's boyfriend. The man was bludgeoned to death with a sledgehammer.

Department of Corrections spokesman John Dipko said the department was pleased with the decision and will continue to enforce rules that are designed to maintain a safe environment.

Singer's court-appointed attorney, W.C. Turner Herbert of North Carolina, also did not immediately return a message seeking comment.

Some thoughts:

1. He was in prison for bludgeoning someone to death with a sledgehammer. Makes me wonder if his character choice for D&D was a tank character.

2. You're in prison, for murder. You don't deserve to have fun.

3. Are other videogames allowed in prison?

4. If videogames are in fact allowed in prison, I know a few people who probably wouldn't be opposed to life in prison. Never having to work or socialize, and being locked in with your videogames all day? Don't mind if I do!

While I agree with thoughts 1 & 2. This is TABLETOP D&D, e.g. no electricity involved.

You know what would have let him keep playing D&D happily all his life? NOT KILLING SOMEONE.

Also, you're a prisoner, and one in there for first degree murder. You don't get free speech rights, asshole, you do what you're told.

I bet his favorite wrestler is HHH, so he absolutely deserves to rot in prison for the rest of his life without the benefit of D&D to amuse him. HHH has always sucked, and so has this guy.

Maybe he can start doing live action role playing in the prison yard instead. I'd imagine prison rules for LARPing would be more extreme than the goofs that do it in their parents backyard.

I think the thing that pisses me off about this the most is that the court had to entertain this whole notion of a murderer needing his murderous D&D games, and it just seems like the court probably has better things to do. Then again, shit like this happens all over. No wonder the legal system sucks, all this time and money being wasted on nonsensical issues. Then you get to the lame lawsuits are there and...

People are sent to prison as punishment not for punishment. Besides, we don't know why dude killed his sisters boyfriend. Maybe he flushed dudes memory cards down the toilet.

This might have meaning if the prison guards were whooping his ass Shawshank-style every day. While I personally wouldn't care, you could call that "cruel/unusual punishment."

But we're talking about the guy wanting to engage in a favorite recreational activity. If we didn't take those things away from people in prison, what would be the deterrent? You might as well put videogames in highschool detention.

Yeah, I understand the idea of "they're being punished, they shouldn't get fun", but keeping prisoners entertained is a must, or they start taking out their boredom on those nearby. Besides, if you have privileges, they can be taken away as punishment. How do you punish someone who already has nothing?

The reasoning behind taking the game away seems to come straight out of a Chick tract and to be honest is one I thought died out in the 80s.

If they really want to punish the guy, give him FATAL.

Exactly! That's why I bolded their "logic." In regard to FATAL, I can just imagine some rules lawyer bitching about the laws of anal circumference in a prison.

let them play the game, i would rather have a fat nerd to guard than somone who works out every day because they have nothing better to do.
